Planning – Use and Development in Bushfire-prone Areas

Council’s Interim Planning Scheme includes a Bushfire-Prone Areas Code that applies to:

  • subdivision of land that is located within, or partially within, a bushfire-prone area; and
  • a use, on land that is located within, or partially within, a bushfire-prone area, that is a vulnerable use or hazardous use.

A planning permit is required for all use and development where this code applies that is not otherwise exempt under clause E1.4 of the code. Clause E1.4 provides:

  • any use or development that the TFS or an accredited person, having regard to the objective of all applicable standards in this code, certifies there is an insufficient increase in risk to the use or development from bushfire to warrant any specific bushfire protection measures; and
  • adjustment of a boundary in accordance with clause 9.3 of this planning scheme.

Building and Plumbing – Use and Development in Bushfire-prone Areas

For building work proposed in a bushfire-prone area, then in addition to noting the above Planning Scheme information, please note the following:

  • Planning Scheme requirements may apply depending on the type of proposed use and development in a bushfire-prone area; and
  • Requirements under the Building Act 2016 may apply depending on the type of proposed building work in a bushfire-prone area.
